Welcome to Polyglobe Music. We sell our products to you subject to the conditions set out on this page. PolyglobeMusic does not accept any other conditions, except for special conditions, confirmed in a written form by the company. |

| §2 Contract and Returns |
| |
Should one or more articles be unavailable on the part of PolyglobeMusic, we are entitled to withdraw from the contract. In this case the customer will immediately be informed about the unavailability of the ordered product. An already paid purchase price will immediately be refunded.
The customer can withdraw from the contract either by sending a written note of withdrawal or by returning the goods within two weeks, beginning from the date of sale, at their own expense and risk.
Please note that PolyglobeMusic may retain the reduction in value caused by the use of the ovject. The right of withdrawl and return does not exist with audio- or video recordings (e.g. CD's, Videocassettes, DVD's) which were opened by the customer (original packaging).
PolyglobeMusic does not sell products for purchase by children. We sell children's products for purchase by adults only. |

| §3 Delivery |
| |
If no other arrangements are made, all items are dispatched to your destination address from PolyglobeMusic in Patsch near Innsbruck. We do our best to process your order as quickly as possible. In general estimated delivery dates are not binding, except for special cases where we have confirmed an obligatory delivery date. |

| §4 Payment Settings |
| |
Your orders plus transport costs are dispatched as soon as the payment has been cleared by your credit card company (Visa, Eurocard, Mastercard). Within Austria we also offer the possibility of a cash payment on delivery. We regret that cash on delivery is not possible outside of Austria. |

| §5 Reservation of proprietary rights |
| |
Please note that delivered items remain the property of PolyglobeMusic until receipt of full payment. |

| §6 Liability for faults |
| |
The purchaser has the right to demand rectification or a substitute delivery, if the purchased item is faulty or defective. If we fail to rectify the goods properly, the ordering party is entitled to either withdraw from the contract, demand a price reduction or, after returning the goods at their own expense and risk, demand a refund.
We do not accept any further liability.
PolyglobeMusic is therefore not liable for any indirect damages incurred. In particular, PolyglobeMusic is not liable for any drops in profits or other financial losses.
As far as the liability of PolyglobeMusic is limited or out of the question, this also concerns the personal liability of employees, sales representatives and accomplices.
Provided that PolyglobeMusic is negligently in breach of contract, the obligation to pay compensation for damage is limited to typical damage incurred.
Any purchaser claims owing to fault are in any case barred after a period of twelve months has expired beginning from the date of delivery. |

| §7 Data Protection |
| |
With the transmission of the order, the customer agrees that the personal data required for the completion of the deal is electronically saved by PolyglobeMusic. If the order is placed via PolyglobeMusic's homepage, the customer has the opportunity to enter his or her credit card number for payment in a special field.
Despite this possibility, PolyglobeMusic stresses that PolyglobeMusic can not give any guarantee for the secure transmission of the customer's personal data. In particular, this warning concerns any credit card data given.
PolyglobeMusic recommends to transmit credit card data via fax or telephone in addition to your Internet order.
Therefore PolyglobeMusic does not accept any claim for compensation in this context. |

All content included on the website, such as text, graphics, other wares or printed matter is the property of PolyglobeMusic, Austria. All rights reserved.
You may not copy any parts or even the entire website, except for placing and order with PolyglobeMusic or using the website as a shopping assistant. In particular, you may not utilise any data mining or similar data gathering and extraction tools to extract for re-utilisation, sale, changes or publication of any substantial parts of this website.
The marks Polyglobe, Acame, Assam, Bengali and Zen are trademarks or registered trademarks of PolyglobeMusic.
These conditions are governed by and construed in accordance with Austrian law. The court of jurisdiction for both parties is in Innsbruck.
By placing an order the customer claims to have read and accepted the Conditions of Use and Sale §1 to 8. |
